These terms govern your use of the OnyxSend platform. By creating an account or using our services, you agree to these terms in full.

1. Service Description

OnyxSend provides an automated B2B outreach platform including prospect discovery, enrichment research, personalized email sequence generation, sending infrastructure with domain warmup, reply classification, and meeting booking automation. Feature availability varies by plan.

2. Subscription and Billing

All plans are billed monthly via Stripe. Subscriptions renew automatically at the start of each billing cycle. Prices are in USD. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until that date. We may change pricing with 30 days written notice.

3. Refund Policy

All payments are non-refundable. Because OnyxSend begins prospect research, domain warmup, and outreach preparation immediately upon activation, we do not offer refunds for any reason, including partial months, unused features, or dissatisfaction with results. You may cancel at any time to prevent future charges, but amounts already paid will not be returned.

4. Client Responsibilities

You agree to:

  • Provide a dedicated sending domain separate from your primary business domain
  • Configure DNS records as instructed for proper email authentication
  • Supply accurate ideal customer profile information
  • Use the platform for legitimate B2B outreach only
  • Comply with CAN-SPAM, GDPR, and all applicable email and privacy regulations
  • Not use the platform to send spam, phishing, deceptive, or illegal content

5. Limitation of Liability

OnyxSend provides outreach infrastructure and automation. We do not guarantee any specific number of meetings, replies, or revenue outcomes. Results depend on your offer, market, targeting accuracy, and other factors outside our control. OnyxSend's total liability is limited to the amount you paid in the preceding 3 months. We are not liable for indirect, incidental, special, or consequential damages of any kind.

6. Data Handling

Prospect data sourced by the platform comes from publicly available sources. You are responsible for ensuring your use of this data complies with applicable laws. We do not sell your account data or campaign data to third parties. See our Privacy Policy for full details.

7. Acceptable Use

We reserve the right to suspend or terminate accounts that violate these terms, send abusive or illegal content, damage platform deliverability, or engage in activity that harms other users. Suspended accounts are not eligible for refunds.

8. Account Termination

You may close your account at any time by contacting support. We may terminate accounts that violate these terms with or without notice. Upon termination, your campaign data will be retained for 30 days before permanent deletion. You may request an export of your data before that period ends.

9. Modifications

We may update these terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance.
